Welcome to NOWEAR, a streetwear brand operated by VIZART USA LLC (“we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your use of our website nowearapparel.com (the “Site”) and the purchase of products from us. By accessing our Site or placing an order, you agree to these Terms. Please read them carefully.

 

1. Use of the Site

  • You must be at least 13 years old (or the age of majority in your jurisdiction) to use our Site or make a purchase.
  • You agree not to use the Site for any unlawful purpose or in violation of these Terms.

 

2. Product Information

  • We make every effort to display product descriptions, colors, and images as accurately as possible. However, we cannot guarantee your device’s display will represent colors accurately.
  • We reserve the right to limit product quantities or discontinue products at any time without notice.

 

3. Orders and Acceptance

  • When you place an order, you are making an offer to purchase.
  • We reserve the right to accept or decline any order, for reasons such as product availability, errors in pricing or product information, or suspected fraud.
  • If we cancel or cannot fulfill your order, we will notify you and issue a refund if payment has already been processed.
  • Orders begin processing immediately after being placed and cannot be modified or canceled once submitted. If you'd like to add another item to your order, please place a new order for the item. We are usually unable to change or cancel an order after you've placed it. 

 

4. Pricing and Payment

  • All prices on this Site are listed in United States Dollars (USD) by default. Customers outside the U.S. may view prices in their local currency using the country selector in the menu. Final checkout prices and charges will be processed in your selected currency, based on current exchange rates. Taxes and shipping fees will be calculated at checkout.
  • We accept major credit/debit cards and other payment methods listed at checkout.
  • By providing payment information, you represent that you are authorized to use the payment method.
  • For pre-order items, payment is collected at checkout and production requires 2–5 weeks before dispatch. By placing a pre-order, you accept these timelines.

 

5. Shipping & Delivery

  • We ship to addresses within USA, Australia, Austria, Canada,  Belgium, Switzerland, Czechia, Germany, Denmark, Spain, Finland, France, United Kingdom, Hong Kong SAR, Ireland, Israel, Italy, Japan, South Korea, Malaysia, Netherlands, Norway, New Zealand, Poland, Portugal, Sweden, Singapore.
  • Shipping times are estimates and not guaranteed. Delays may occur due to carriers or unforeseen circumstances.
  • For inquiries regarding undelivered orders, please contact Client Services at help@nowearbrand.com and initiate a carrier claim. Delivery discrepancies must be reported within 10 business days of scheduled delivery. Claims submitted after this period cannot be processed.
  • For pre-order items production requires 2–5 weeks before dispatch. By placing a pre-order, you accept these timelines.

 

6. Returns & Exchanges

  • We accept returns within 14 days of delivery for unused, unworn, and unwashed items in their original condition with tags attached.
  • Certain items (such as final sale items) may be non-returnable.
  • To initiate a return, please follow the instructions on our Returns & Exchanges page.
  • Refunds will be issued to the original payment method, minus any applicable shipping costs.

 

7. Promotions & Discounts

  • Promotions, discounts, or offers cannot be combined unless expressly stated.
  • We reserve the right to modify or cancel promotions at any time.

 

8. Intellectual Property

  • All content on the Site (logos, images, text, design) is the property of VIZART USA LLC or its licensors and is protected by intellectual property laws.
  • You may not copy, distribute, or exploit any content without our written consent.

 

9. Limitation of Liability

  • To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Site or purchase of products.
  • Our total liability for any claim relating to a product shall not exceed the purchase price of that product.

 

10. Governing Law

  • These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
  • Any disputes shall be resolved exclusively in the courts of Los Angeles County, California.

 

11. Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date.
